BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE THE SERVICE.

We reserve the right to modify these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

2. Eligibility

You must meet the following requirements to use the Service:

You must be at least 13 years of age
If you are between 13 and 18, you must have parental or guardian consent
You must have the legal capacity to enter into a binding contract
You must not be prohibited from using the Service under applicable law
You must provide accurate and complete registration information

By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Account Registration and Security

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

Maintain and promptly update your account information
Maintain the security of your password and account credentials
Notify us immediately of any unauthorized access or security breach
Accept responsibility for all activities that occur under your account

3.2 Account Termination

Fraudulent, abusive, or illegal activity
Extended periods of inactivity
Request by law enforcement or government agencies

You may terminate your account at any time by contacting support@orirify.com. Termination does not relieve you of any obligations incurred prior to termination.

4. Service Description and Limitations

4.1 Service Overview

Orirify provides an AI-powered technical interview practice platform designed to help users prepare for software engineering, machine learning engineering, and behavioral interviews. The Service includes real-time voice conversations, code execution environments, and automated feedback systems.

4.2 Service Limitations

You acknowledge and agree that:

The Service is for practice and educational purposes only
AI-generated feedback is not a substitute for professional career advice
We do not guarantee specific outcomes, job offers, or interview success
The Service may not perfectly replicate actual interview conditions
Technical issues, downtime, or service interruptions may occur
We may modify, suspend, or discontinue features at any time

5. Subscription Plans and Payments

5.1 Pricing and Plans

We offer various subscription plans with different features and interview credits. Current pricing is available on our pricing page. We reserve the right to modify pricing at any time, with notice to existing subscribers.

5.2 Payment Terms

All fees are in U.S. dollars unless otherwise stated
Payment is processed through Stripe, a third-party payment processor
You authorize us to charge your payment method for all fees incurred
Fees are non-refundable except as required by law or stated in our refund policy
You are responsible for all taxes associated with your purchase

5.3 Interview Credits

Interview credits are subject to the following terms:

Credits expire according to your plan's validity period
Unused credits do not roll over unless specified in your plan
Credits are non-transferable and have no cash value
One credit is consumed per interview session started
Credits are not refunded for incomplete or abandoned interviews

5.4 Refund Policy

Refunds are available under the following conditions:

Within 7 days of purchase if no interviews have been completed
If the Service is unavailable for more than 48 consecutive hours
If we terminate your account without cause

To request a refund, contact support@orirify.com with your order details. Refunds are processed within 10 business days.

6. Acceptable Use Policy

6.1 Prohibited Activities

You agree NOT to:

Use the Service for any illegal or unauthorized purpose
Violate any laws, regulations, or third-party rights
Attempt to gain unauthorized access to the Service or other users' accounts
Reverse engineer, decompile, or disassemble any part of the Service
Use automated tools (bots, scrapers) to access the Service
Interfere with or disrupt the Service or servers
Upload malicious code, viruses, or harmful content
Impersonate any person or entity
Harass, abuse, or harm other users
Share your account credentials with others
Resell, redistribute, or commercialize the Service without authorization
Extract or copy interview questions, AI models, or proprietary content
Use the Service to train competing AI models or services

6.2 Content Standards

Any content you submit (code, messages, feedback) must:

Not contain offensive, discriminatory, or hateful language
Not infringe on intellectual property rights
Not contain personal information of others without consent
Not contain spam, advertising, or promotional content

7. Intellectual Property Rights

7.1 Our Intellectual Property

The Service and all content, features, and functionality (including but not limited to software, text, graphics, logos, interview questions, AI models, and algorithms) are owned by Orirify and are protected by copyright, trademark, patent, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

7.2 Your Content

You retain ownership of code and content you create using the Service. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

Store, process, and display your content to provide the Service
Use aggregated, anonymized data for analytics and improvement
Generate AI feedback and evaluations based on your submissions

We will not share your individual code or interview responses with third parties except as described in our Privacy Policy.

8. Disclaimers and Limitations of Liability

8.1 Service Provided "AS IS"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability, fitness for a particular purpose, or non-infringement
Warranties that the Service will be uninterrupted, secure, or error-free
Warranties regarding the accuracy, reliability, or completeness of content or feedback
Warranties that defects will be corrected

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORIRIFY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Damages resulting from your use or inability to use the Service
Damages resulting from unauthorized access to your account or data
Damages resulting from errors, bugs, or technical issues
Damages resulting from third-party content or services

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless Orirify and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to:

Your use or misuse of the Service
Your violation of these Terms
Your violation of any rights of another party
Your violation of any applicable laws or regulations
Content you submit to the Service

10. Dispute Resolution and Arbitration

10.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@orirify.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.

10.2 Binding Arbitration

If informal resolution fails, you agree that any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

Arbitration will be conducted by a single arbitrator
Arbitration will take place in [Your State/Country]
The arbitrator's decision is final and binding
Each party bears its own costs and attorneys' fees
You waive your right to a jury trial

10.3 Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION.

10.4 Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the Service.

11. Third-Party Services

The Service may integrate with or contain links to third-party services, including:

OpenAI for AI-powered conversations
Stripe for payment processing
Supabase for authentication and data storage
Other third-party tools and services

We are not responsible for the content, privacy practices, or terms of service of third-party services. Your use of third-party services is subject to their respective terms and policies.

12. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, for any reason. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

14. Governing Law and Jurisdiction
